1. Provider and scope

The provider is Berlin International Piano Masterclass e.V., postal address: BIPM, Lychener Straße 21, 10437 Berlin, Germany. Contact: management@berlinerklavierfesttage.com. The legal notice identifies the association and its representatives.

These terms are intended for services for which the association itself is the contracting party: festival events, separately agreed academy services, support arrangements and voluntary donations. They apply only if validly agreed when a contract is made. Individual agreements and mandatory legal rights take precedence. For purchases through another provider, its role and the conditions disclosed before purchase determine the relevant contractual arrangements.

2. Enquiries and bookings

A contact enquiry, account, expression of interest or application alone creates no payment obligation. An automatic acknowledgement initially confirms receipt only. Before a binding paid booking, the service, date or period, contracting party, total price, payment method and any specific participation conditions must be stated. The expressly binding booking and its acceptance determine contract formation. External sellers explain their own booking process. A donation is distinct from a purchase.

3. Prices, invoices and payments

The total price disclosed before contracting is in euros and includes taxes legally due. Any additional charges must be expressly disclosed before ordering. A tax exemption is stated only where it actually applies to the specific service. Payment methods and due dates follow the offer or agreement. These terms add no processing charges, contractual penalties or flat reminder fees; otherwise statutory rules apply.

Please provide an accurate billing name and full address. Invoices include legally required service, tax and issuer details where applicable. The lawful invoice format depends on applicable requirements and any necessary agreement; a PDF is not automatically a structured electronic invoice. Please report incorrect billing details for correction. Statutory rights to dispute an invoice remain intact.

An account payment overview, a payment processor confirmation and an invoice have different purposes. A status display replaces neither a valid invoice nor a charitable tax receipt.

4. Concert attendance, changes and cancellation

The disclosed event details and lawful venue safety and house rules govern admission. Concessions require the stated eligibility and, where requested, suitable evidence. If an event is cancelled, postponed or materially changed, we explain the arrangements. Statutory rights, including refunds for a service not provided and any further applicable rights, remain intact. A programme or artist change does not automatically remove these rights. External sellers may operate the refund process, without removing claims against the relevant contracting party.

For concert attendance on a specified date, the statutory distance-selling withdrawal right is generally excluded under section 312g(2)(9) of the German Civil Code. This does not remove rights concerning cancellation or defective performance. Any withdrawal right for another offer is explained separately. The concert-ticket exception is not applied indiscriminately to academy services or donations.

5. Academy and other support arrangements

Paid teaching, course and participation offers require separately disclosed services, dates, fees, selection procedures and any cancellation terms before a binding booking. An application alone grants no place and creates no fee obligation. These terms introduce no undisclosed cancellation charges. Sponsorship involving agreed benefits, membership fees and paid support services require separate agreements and accounting. An account or friends-circle enquiry alone creates neither association membership nor recurring payments.

6. Voluntary donations and payment providers

Donations are voluntary contributions without entitlement to an economic benefit, tickets, tuition or preferential admission. You select the amount and any repetition offered. The website supports one-off, monthly and annual donations, with the chosen arrangement shown before payment is completed.

Online payments use Stripe. The amount, currency and expressly selected repetition shown before confirmation apply. A redirect, abandoned checkout or return to the website does not itself establish receipt. Only confirmed incoming payments are recorded as received. For bank transfers use only the bank details displayed on our donation page.

A recurring donation continues at the selected interval until ended. You can stop future payments through the available donation management or by emailing management@berlinerklavierfesttage.com. These terms introduce no minimum term or cancellation charge. We confirm cancellation and when further payments cease. Already initiated payments, statutory recovery rights and rights against the payment provider are assessed separately. Increasing an amount or changing an interval requires your renewed agreement.

7. Payment errors, refunds and restricted purposes

Please report duplicate, incorrect or unauthorised payments promptly with the date, amount and payment reference. Do not send full card details. We investigate and generally return justified refunds through the original payment method. Statutory deadlines and rights remain intact; contacting us does not replace any necessary notice to your bank.

Donations support the association's statutory purposes. A specific restriction applies only if expressly agreed. If an agreed purpose cannot be fulfilled, we discuss further use or any required refund with you where legally permitted. These terms neither exclude all donation recovery claims nor guarantee tax deductibility.

8. Donation documents and tax receipts

A donation without consideration is not invoiced as a taxable service. A Stripe payment confirmation is not a charitable tax receipt issued by the association, and an automatic account entry does not establish tax eligibility.

You can request a donation receipt through the donation page. A charitable tax receipt may be issued only if the legal conditions and the association's actual authority to issue it are satisfied, and only for funds actually received. Accurate donor and address details are required. The competent tax authority determines individual tax recognition. Simplified proof is sufficient only if its statutory conditions are met. If a donation is refunded after a receipt is issued, the receipt must be adjusted. Please stop using an inaccurate receipt and contact us for correction.

9. Accounts, privacy and recordings

Protect account credentials and keep payment and billing information current. The privacy policy and cookie settings explain personal data processing, providers and optional consent. A newsletter subscription or optional analytics is not a condition for a contract or donation. Copyright, performers' rights and personality rights in photos, films and recordings remain intact. Attending an event or accepting these terms does not replace any required consent to personal recordings and publication. Your own recordings depend on the rights of those involved and lawful venue rules.

10. Liability and statutory rights

Statutory liability rules apply. These terms do not restrict claims for injury to life, body or health, intentional or grossly negligent conduct, or any other mandatory liability. Warranty, refund and data protection rights remain intact.

11. Contact, disputes and amendments

For bookings, invoices, donations and receipts, contact management@berlinerklavierfesttage.com or the postal address above. The association is neither willing nor obliged to participate in proceedings before a consumer arbitration board. Access to the competent courts remains available. Mandatory consumer protection, including applicable protection at a consumer's habitual residence, remains intact. These terms impose no exclusive consumer jurisdiction. A new published version does not automatically change existing contracts or recurring donation arrangements. Any required agreement to a change will be sought separately.
